Advertie Digital is a digital marketing company based in South Africa offering a range of services, including Graphic Design, Website Design, Video Production, Photography, and Digital Marketing.

These Terms of Service (“Terms”) govern your use of our services. By engaging Advertie Digital or using any of our services, you agree to be bound by these Terms. Please read them carefully before proceeding.

2. Intellectual Property

Advertie Digital retains full ownership and intellectual property rights to all designs, graphics, logos, videos, websites, and other creative materials produced as part of our services until full payment has been received.

Upon full payment, Advertie Digital grants you a non-exclusive, non-transferable license to use the deliverables solely for the purposes specified in your project agreement or proposal.

You may not reproduce, modify, resell, distribute, sublicense, or claim authorship of any materials created by Advertie Digital without prior written consent. This includes using our work for purposes outside the original scope of engagement.

3. Copyright and Third-Party Rights

Advertie Digital respects the intellectual property rights of others and expects the same from its clients. You are responsible for ensuring that all materials, content, or information you provide do not infringe on the rights of any third party.

If you believe that any material created or provided by Advertie Digital infringes your copyright, please notify us immediately at info@advertie.co.za, and we will promptly investigate and remove any infringing content if confirmed.

4. Client Responsibilities

The client agrees to:

• Provide all required materials, content, and approvals promptly to ensure timely project completion.

• Ensure all information and materials provided are accurate, lawful, and authorized for use.

• Review and approve deliverables within the specified time frame. Delays in feedback may extend project timelines.

Advertie Digital will not be held responsible for delays caused by the client’s failure to provide necessary input or approvals.

5. Third-Party Materials and Fees

If a project requires third-party assets such as stock photos, videos, fonts, plugins, or hosting, these costs are the responsibility of the client unless otherwise stated in writing.

Advertie Digital is not liable for any third-party materials, licensing restrictions, or availability issues that may arise.

6. Analytics and Third-Party Tools

Advertie Digital may utilize third-party analytics services to collect data related to your website or social media performance. By using our services, you consent to the collection and processing of data by these third-party providers in accordance with their respective privacy policies.

7. Confidentiality

Advertie Digital will maintain strict confidentiality regarding all information provided by the client and will not disclose any confidential materials to third parties without prior written consent, except as required by law.

8. Payment Terms

• A 50% non-refundable deposit is required before the commencement of any project.

• The remaining 50% balance is due upon completion of the project, prior to final delivery or publication.

• Payments may be made via bank transfer or debit/credit card.

Failure to make payments as agreed may result in suspension or termination of services. All completed work remains the property of Advertie Digital until full payment is received.

9. Refunds

If you are unsatisfied with our services, please contact us so we can resolve the issue. Refunds are not guaranteed and are issued solely at the discretion of Advertie Digital, based on the circumstances and stage of the project.

No refunds will be provided for:

• Completed or approved work.

• Delays caused by the client.

• Termination due to breach of these Terms.

10. Limitation of Liability

Advertie Digital shall not be liable for any direct, indirect, incidental, special, or consequential damages, losses, or expenses arising from the use or inability to use our services, including but not limited to data loss, loss of revenue, or business interruption.

11. Indemnity

The client agrees to indemnify, defend, and hold harmless Advertie Digital, its directors, employees, partners, and agents from and against any claims, damages, liabilities, or expenses (including legal fees) arising out of:

• The client’s breach of these Terms; or

• The client’s use of materials or content in violation of any third-party rights.

12. Termination of Services

Advertie Digital reserves the right to terminate any project or service immediately if the client violates these Terms or engages in unlawful or unethical conduct.

In the event of termination:

• All work completed remains the property of Advertie Digital.

• No refunds will be issued for payments already made.

13. Amendments to the Terms

Advertie Digital reserves the right to modify or update these Terms of Service at any time. Changes will take effect upon posting to our website or written communication. Continued use of our services after such changes constitutes acceptance of the updated Terms.

14. Governing Law

These Terms are governed by and construed in accordance with the laws of the Republic of South Africa. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the South African courts.
